<p>Prime Minister Sher Bahadur Deuba has said that the Government of Nepal will provide patronage to all Nepalis in Afghanistan waiting for the rescue.&nbsp;&nbsp;&nbsp;&nbsp;</p>



<p>PM Deuba said that the government has already taken cognizance of the issue.&nbsp;He said necessary coordination and guardianship is the responsibility of the government for the Nepalis waiting for safety and rescue. The government will fulfill this responsibility with awareness and seriousness.</p>

<p>“We have formally written to embassies requesting them for the evacuation,” Nepal Foreign Ministry spokesperson Sewa Lamsal tells media outlets in Kathmandu.</p>



<p>Lamsal says the government has also set up a panel to determine the exact number of Nepalis working in Kabul and elsewhere in Afghanistan.</p>

<p>According to the constitution of Nepal, the constitution is the basic law of the country and sovereign power and state power is vested in the Nepali people. There is no one above the constitution. The constitution clearly states that the leaders of the parties elected by the people must work for the country and the people. But the leaders of the political parties have been leaning on the heads of the people and treating themselves as masters and the people as servants. The Supreme Court has slammed Prime Minister KP Sharma Oli&#8217;s deceptive politics, undemocratic character, unconstitutional regime and illegal parliamentary proceedings. The decision of the Supreme Court in favor of democracy, democracy, republic, constitutionalism, people and rule of law in the history of Nepal will be written in golden letters on 2078/3/28. </p>



<p>The decision states that the disputed dissolution of the House of Representatives of the Federal Parliament did not appear to be conducive to the democratic ideals, values, constitutionalism and constitutional ethics enshrined in Article 76 and Article 7 of the Constitution of Nepal. </p>



<p>The dissolution did not seem to be conducive to the interpretation of the constitution and the order issued by the Supreme Court on 2077/11/11. Giving judicial recognition to such acts of dissolution seems to have a negative and serious impact on the country&#8217;s constitutional system. </p>



<p>The decision taken by the President on 2078/2/7 saying that the claim submitted by 149 people including the Honorable Member of the House of Representatives Shri Sher Bahadur Deuba for the post of Prime Minister could not be met was not found to be in line with the constitution. </p>



<p>According to the decision made by the Hon&#8217;ble President on 2078/2/7 that the claim submitted by 149 people including Sher Bahadur Deuba could not be met and then the House of Representatives of the Federal Parliament was dissolved by the Hon&#8217;ble Prime Minister on 2078/2/7. As per the recommendation made by the Hon&#8217;ble President, the decision of the Hon&#8217;ble President regarding the dissolution of the House of Representatives dated 8th June, 2078 BS, all the proceedings including the information and press release issued accordingly are annulled by the order of subpoena and consequently the House of Representatives of the dissolved Federal Parliament is reconstituted. </p>



<p>According to the above case, the session of the reconstituted House of Representatives will be convened within 7 days from today, i.e. 5 pm on Sunday, August 19, 2070 BS. </p>



<p>The Prime Minister appointed under Article 76, Clause 3 of the Constitution of Nepal has not received a vote of confidence from the House of Representatives pursuant to Clause 4 or he has abandoned the process. Sharma Oli&#8217;s claim for appointment to the post of Prime Minister as per Article 76, Sub-Article 5 does not appear to be constitutional. </p>



<p>The decision made by Mr. Sher Bahadur Deuba to have the support of 149 members of the House of Representatives for the appointment of the Prime Minister as per Article 76.5 of the Constitution has been reversed as mentioned in the above case. </p>



<p>Now, from the point where there has been an error in the use and observance of the constitution, it seems reasonable to move the process forward in accordance with the constitution. Article 76, Clause 5 of the Constitution of Nepal provides that a member of the House of Representatives may obtain a vote of confidence in the House of Representatives. For that purpose, 149 members of the House of Representatives shall be considered as a basis for obtaining a vote of confidence. As there is sufficient and reasonable basis to do so, accordingly, within two days from today, that is, by 5 pm on Tuesday, July 12, 2078 BS, as per the above, the members of the House of Representatives who have submitted their demands to the Hon&#8217;ble President on 2078/2/7 will be appointed as the Prime Minister. An order shall be issued in the name of the Office of the President and the reconstituted House of Representatives of the Federal Parliament to complete the process of obtaining a vote of confidence pursuant to Clause 6 of Article 76. </p>



<p>Pursuant to Article 76, Clause 5 of the Constitution of Nepal, for the purpose of appointing the Prime Minister, as per the Political Parties Act, 2073, no action can be taken against the party for resigning from the post of Prime Minister. Prohibition order shall be issued in the name of the candidates not to take action against any member of the House of Representatives for expressing his / her opinion or voting. </p>



<p>Therefore, a bench of Chief Justice Cholendra Shamsher Rana, Justices Deepak Kumar Karki, Mira Khadka, Ishwar Prasad Khatiwada and Ananda Mohan Bhattarai has ruled that the decision of Prime Minister KP Sharma Oli and President Vidyadevi Bhandari to dissolve the House of Representatives for the second time is unconstitutional. The decision is in line with the democratic ideals, values, constitutionalism and constitutional law assimilated by the constitution. The people who hold high positions in the governance system of the country who receive salary allowance from the taxes paid by the Nepali people will have to work for the Nepali people as masters and servants of their people. There is no one above the constitution and the law. Leaders will not be allowed to abuse their position. The ruling clearly states that party leaders do not have the right to rule the people in an autocratic manner. </p>



<p>This is the day of victory for all of us Nepali people who believe in democracy. The court today has truly become a temple of justice. Tomorrow, the court will have to decide its fate in the same way in favor of the people and justice. There is no doubt that the development of Nepal and Nepalies will move forward at a rapid pace. This decision will not give an opportunity to the leaders and activists of KP Oli&#8217;s tendency to be undemocratic in Nepali politics. Even then, the game of reaching power on the heads of the people and utterly abusing the taxes paid by the people must be stopped. This decision has given Sher Bahadur Deuba a chance to become the Prime Minister as per the constitution. But because Deuba is a corrupt leader, the history of the past is not good and even now he is not qualified to do a good job according to this constitution. After Deuba gets the vote of confidence, a new qualified young Prime Minister has to be appointed with the consent and cooperation of all parties. Otherwise, the politics of the Nepali Congress will end. Implementation of this constitution by the old party is not possible. The emergence of a new democratic and democratic party has become inevitable for the rapid development of Nepal and Nepalese.</p>

<p>The constitution of Nepal is the supreme law of the country and according to this constitution KP Sharma Oli has been appointed as the Prime Minister from the House of Representatives and Vidhyadevi Bhandari has also been appointed as the President.</p>



<p>Since both of them have repeatedly dissolved the House of Representatives against the constitution law of the country, they do not seem to have the general knowledge that the constitution must be followed. In both, there is a desire to violate the constitution and to become a dictator. If people in high positions like the President and the Prime Minister are not punished for repeatedly violating the constitution, this step will be repeated and there is a strong possibility that democracy will be endangered.</p>



<p>The House of Representatives, which was dissolved by President Bidyadevi Bhandari on the recommendation of Prime Minister KP Sharma Oli, was re-established by a decision of the Constitutional Court of the Supreme Court on March 25.</p>



<p>It is unconstitutional for President Bhandari to dissolve the parliament again and declare the election at midnight on the recommendation of the Prime Minister, contrary to the decision of the Constitutional Court of the Supreme Court, as the Parliament did not take any action against both the Prime Minister and the President. It is clear that this act is contrary to Articles 1,2,5,75,76,77,100 of the Constitution, including the preamble of the Constitution.</p>



<p>Respected Supreme Court should take action against both the Prime Minister and the President for disobeying the Constitution and the court&#8217;s decision. Both should be punished for contempt of court in order to prevent the Nepali people from sacrificing their lives for constitutionalism, rule of law, democracy, human rights, multi-party system, independent judiciary, and fundamental rights of the people.</p>



<p>According to Article 76 of the Constitution, the Parliament cannot be dissolved until all the options of forming a government are fulfilled. According to the decision of the Supreme Court, in order for the parliament to be dissolved, all the processes of forming the government should have been completed as per sub-sections 1, 2, 3, 4 and 5 of Article 76. However, it is clear that KP Oli, who was relieved of the post of Prime Minister in accordance with Article 76 (4) and Article 77 of the Constitution, has completely dissolved the House of Representatives by violating the above articles.</p>



<p>Considering the overall structure of Articles 1, 2, 3, 4 and 5 of Article 76 of the Constitution, one process after another is being implemented in the House of Representatives in a practical manner. According to Article 7, there seems to be a constitutional provision for the dissolution of the House of Representatives on the recommendation of the Prime Minister who is immediately appointed in accordance with Article 76 (5). Therefore, it is clear that KP Oli, who was relieved of the post of Prime Minister and did not have a vote of confidence from the House of Representatives, completely violated it and dissolved the House of Representatives in an unconstitutional manner.</p>



<p>In Article 85, Clause 1 of the Constitution, &#8220;Unless otherwise dissolved in accordance with this Constitution,&#8221; the Prime Minister shall not be appointed in accordance with Articles 1, 2, 3 and 5 of Article 76, or any other member of the House of Representatives shall be appointed Prime Minister. It is mentioned in the decision that there is a constitutional provision that the House of Representatives will be dissolved as per sub-section 7 of section 76 after the option is exhausted.</p>



<p>Prime Minister KP Sharma Oli is a minority prime minister appointed under Article 76, Sub-Article 3 of the Constitution. Oli said that the President has started the process of forming the government as per Article 5 without taking a vote of confidence as per Article 4. However, the process was not completed and President Bhandari dissolved the parliament on the recommendation of Prime Minister Oli. It is clear that the dissolution of the Parliament without completing the process as per Article 76 of Article 76 of the Constitution is contrary to the decision of the Supreme Court and Article 76 (5).</p>



<p>Oli, who is the prime minister under Article 76 (2) of the constitution, had announced a &#8220;sudden&#8221; vote of confidence in the House of Representatives. Oli, who resigned on April 11 after failing to get a vote of confidence from the House of Representatives, was appointed prime minister by a minority vote on April 12, according to Article 76, Clause 3 of the Constitution.</p>



<p>According to the constitution, he had one month to get a vote of confidence from the House. However, without seeking a vote of confidence from the parliament, Oli had recommended to President Vidyadevi Bhandari to start the process of forming the government as per Article 76 (5), saying that there was no basis for him to gain the confidence of the parliament within a week of his re-election. Which is completely unconstitutional.</p>



<p>Accepting Oli&#8217;s unconstitutional proposal without completing the process envisaged by the constitution, President Bhandari had given about 21 hours to the members of the House of Representatives to submit their demands to the Prime Minister in accordance with Article 76 (5) of the Constitution, which is unconstitutional.</p>



<p>According to Article 76, Clause 3 of the Constitution, the government had to go for a vote of confidence in accordance with Clause 4 within 30 days and if it did not get it, the President had to call for a proposal to form a government under Clause 5. It is completely unconstitutional for Bhandari to dissolve the parliament on the basis of the &#8216;request&#8217; made by the Prime Minister without completing the process.</p>



<p>As the Prime Minister KP Oli has &#8216;self-declared&#8217; that he is in the minority and does not even get a vote of confidence, it is not possible to claim for the post of Prime Minister even as per sub-section 5 of section 76 of the Constitution. Oli&#8217;s claim that he has the support of 153 lawmakers, including 121 from the CPN-UML and 32 from the Janata Samajwadi Party, is completely false and unconstitutional. Because 27 lawmakers from Oli&#8217;s party, 61 from the Nepali Congress, 48 from the CPN-Maoist Center, 13 from the Janata Samajwadi Party and 13 from the JSP have signed a proposal to make Sher Bahadur Deuba the prime minister, the president appointed Deuba as the prime minister and a representative for a vote of confidence under Article 76(4). The meeting had to be called.</p>



<p>Oli had gone to claim the names of the lawmakers with the signatures of the party president and the leader of the parliamentary party, while Deuba had taken the signatures of 149 lawmakers. However, President Bhandari along with Oli also rejected Deuba&#8217;s claim. After the president rejected both claims, Oli recommended dissolving parliament and setting a date for mid-term elections.</p>



<p>As per Oli&#8217;s recommendation, President Bhandari dissolved the parliament at midnight and called for mid-term elections. This act is clearly contrary to the interpretation of Article 76, Clause 5 of the Supreme Court in the previous dissolution controversy. In Chapter 3 of the judgment, the Supreme Court has clearly spoken about the formation of a government under sub-sections 1, 2, 3 and 5 of Article 76. According to these four articles, the Supreme Court has categorically stated that the Prime Minister can be dissolved only if he is not appointed or if the appointed Prime Minister fails to get a vote of confidence.</p>



<p>Explaining the brief decision, it is said that two prime ministers can dissolve the parliament. The Prime Minister who has been appointed as per sub-section 3 of section 76, but has been appointed as a caretaker prime minister after completing the process of section 76, and the prime minister who has been appointed under sub-section 5 but has not received a vote of confidence, can be dissolved under section 7. However, Prime Minister Oli does not appear to have met both the terms of the constitution and the Supreme Court&#8217;s interpretation.</p>



<p>Prime Minister Oli is not the Prime Minister who has completed the process of Article 4 after being appointed under Article 76, and the President has not made anyone the Prime Minister as per the procedure of Article 5. Therefore, it is clear that the process of dissolving this parliament is unconstitutional.</p>



<p>Therefore, without preparing the full text of the decision of the Constitutional Bench of the Supreme Court, on the recommendation of the Prime Minister, President Bhandari again dissolved the Parliament at midnight and declared elections, it all is clear that they have become unconstitutional contrary to the spirit and letter of the preamble of the constitution including 1,2,5,75,76,77,100 respectively.</p>

<p>Kathmandu, Nepal- Nepal on Sunday decided to suspend all the domestic flights from Monday midnight and international flights from Wednesday.</p>



<p>As per the recommendations made by the Central COVID-19 Crisis Management Center (CCMC), the Meeting of Council of Ministers held Sunday had taken the decision to this effect in order to curb the spread of the coronavirus.  </p>



<p>The flights will remain suspended until May 14, according to Minister for Foreign Affairs Pradip Kumar Gyawali.</p>



<p>Nepal on Sunday reported over 7,200 infections, the highest-single day surge of coronavirus cases, breaking its past record of 5743 cases reported on a single day on October 21, 2020.</p>

<p>The Covid-19 Crisis Management Centre on Sunday had recommended the Council of Ministers to authorize District Covid-19 Crisis Management Centres to take a call on restrictive measures to address the situation.</p>



<p>With the new prohibitory order, vehicles other than emergency service will not allow driving on the roads in Kathmandu Valley. While shops would be allowed to open from 5am to 10am.<br><br>The Ministry of Health and Population on Monday confirmed new 3,442 cases of COVID-19, taking the nation&#8217;s novel coronavirus tally to 303,561. Kathmandu Valley recorded 1,498 new infections–1,132 cases were confirmed in Kathmandu, 270 in Lalitpur, and 96 in Bhaktapur.</p>



<p>The district administration offices will announce the decisions today after holding consultation with the Home Ministry.&nbsp;</p>



<p>Minister for Foreign Affairs Pradeep Kumar Gyawali said in a media meeting on Monday that the government is not contemplating nationwide lockdown at the moment.</p>



<p>“Lockdown is not the ultimate option for solving the issues pertaining to coronavirus pandemic which is rapidly spreading in the country”, Gyawali has said in a media meeting on Monday.</p>



<p>He said &#8220;Lockdown only breaks the chain for a while and pushes the inevitable little further, it is not the solution. &#8220;For now we urge the citizens to rigorously follow necessary health protocols,&#8221; he added.</p>

<p>The National Rhino Count 2021 showed a promising 16% increment to 752, from the previous survey in 2015, Nepal’s Department of National Parks and Wildlife Conservation said Saturday. Rhino count 2015 estimated 645 in Nepal’s Terai Arc Landscape.</p>



<p>The National Rhino Count 2021 began on 22 March 2021 and concluded on April 10, 2021 covering rhino range areas within the country including Chitwan National Park, Parsa National Park, Bardia National Park, and Shuklaphanta National Park as well as their buffer zones and vicinities outside protected areas.</p>



<p>“The overall growth in population size is indicative of ongoing protection and habitat management efforts by protected area authorities despite challenging contexts these past years,” stated <a href="https://www.wwfnepal.org/?uNewsID=367155&amp;fbclid=IwAR21MRgG8F7Ar2pTOMLeNsyJ4NtVc6it9p5LKwEVfrU3gpVIl1XRbnvhDmk">Ghana Gurung</a>, Country Representative of WWF Nepal. “This achievement is yet another milestone in Nepal’s conservation journey showcasing the impact of concerted efforts of all stakeholders and providing much needed impetus to the global conservation fraternity.”<br><br>The count was conducted in collaboration with the Department of Forests and Soil Conservation, Nepal Army, Buffer Zone Users Committee, Community Forest Users Groups, NTNC, WWF Nepal, ZSL Nepal and other local organizations.<br> <br>Every five years, Nepal takes up the immense task of counting its rhinos to monitor their status in the wild. The rhino count supports the assessment of management effectiveness in these regions and guides the nation’s rhino conservation strategy.</p>

<p><br><strong>1) Daily meals (ja)</strong>: The meal consists of rice (ja), dal (ke) and vegetable (tarkari).&nbsp; The same meal is eaten morning and evening. If one can afford, meat (la) item is seen on the side of Newar’s regular meal.<br><br><strong>2) Snack (baji)</strong>: Newars prefer to eat snacks in the afternoon. It generally consists of flattened rice (baji), eaten with such items as roasted and curried soya beans (musya), fermented mustard leaves (gundro), or curried potato (alu tarakari). They also have some meat (la) and home- made liquor (thon) with it. Baji is called chiura in Nepali.<br><br><strong>3) Festival meals (Bhoye)</strong>: Another main category of food is served at feasts. In this meal also beaten rice (baji) is the main dish. At feasts various preparations based on buffalo meat are served along with curries of vegetables and pulses. Home-made liquor (thon) is served along with the food. Generally, feast meal is concluded by serving curd, sugar and fruit (sisapusa). Pieces of betel nuts and cloves are also served at end of the meal.</p>



<p>Kwati&nbsp;(soup of different beans), Kachila (spiced minced meat),&nbsp;Choila&nbsp;which is water buffalo meat marinated in spices and grilled over the flames of dried wheat stalks, wo (lentil cake), paun kwa (sour soup), stuffed lung, fried liver, fried tongue, tripe stuffed with bone marrow and jellied fish soup are some of the popular festival foods. Dessert consists of dhau (yogurt), sisabusa (fruits) and mari (sweetmeat). Thwon and aila are the common&nbsp;alcoholic liquors&nbsp;that Newars make at home.</p>



<p><strong>Festivals and Gatherings:</strong> At meals, festivals and gatherings, Newars sit on long mats in rows. Typically, the sitting arrangement is hierarchical with the eldest sitting at the top and the youngest at the end. </p>



<p><strong>Spices</strong>: Newar cuisine makes use of mustard oil and of the most commonly used spices such as cumin, sesame seeds, turmeric, garlic, ginger, mint, bay leaves, cloves, cinnamon, pepper, chili, and mustard seeds.</p>

<p>WASHINGTON D.C.-  Nepal Ambassador to U.S Dr. Yubraj Khatiwada said the Nepali community needs to be on the watch out for any possible targeted hate crimes in the area where they reside. He expressed his sympathy and condolences to the victims and families of recent violence and incidents targeting Asian Americans.</p>



<p>Khatiwada also urged to maintain the peace and harmony despite of difficulties.</p>



<p>During a virtual event organized Monday evening by <a href="https://www.americanepalsociety.org/">America Nepal Society (ANS)</a>, he said his team at the embassy will be committed to strengthen the bilateral relationship with United States.</p>



<p>He emphasized his tenure will focus on the government’s objectives to increase foreign investment, promotion of tourism and export of Nepalese manufacturing as key to “prosperous Nepal, happy Nepali”. Khatiwada said; Nepal&#8217;s strategic ties with the US will be taken to new heights as US-Nepal bilateral relationship has marked 70 plus years since 1947 A.D.</p>



<p>Khatiwada sound confident that there is an opportunity from his previous roles as governor, finance minister, and vice chair of national planning commission, and new horizon can be achieved. Khatiwada believes he will be able to generate enough resources and significant work can be done towards building trade partnership between two countries.</p>



<p>Ambassador Khatiwada expressed how his desire to meet and interact with Nepali diaspora leaders has been on hold until COVID-19 vaccination is received by large population in DC Metro area.&nbsp;</p>



<p>He thanked and congratulated ANS President Ms Prabha Deuja and the team for the effort made towards awareness and vaccination of Nepali community residing in Fairfax county and DC Metro.&nbsp;<br><br></p>



<p>Khatiwada’s appointment as Nepali ambassador to US is seen with high hopes in DC Metro and northern America as he is known as a person well-versed on economy, finance and development issues.</p>

<p>Kathmandu (GNB)- President of the Republic of Nepal&nbsp;Bidya Devi Bhandari has dissolved the House of Representatives of the Federal Parliament and set new dates for the mid-term general election in May 2021.</p>



<p>President Bhandari has announced April 30 for the first phase and May 10 for the second phase of the mid-term&nbsp;election.&nbsp;</p>



<p>Issuing a statement on Sunday, December 20, the Office of the President stated that President has approved the recommendation of the Council of Ministers, stepping on Article 76 (1) and (7) and Article 85 of the constitution.</p>

<p>Earlier on Sunday, an emergency meeting of the Cabinet decided to recommend to the President dissolution of the federal parliament. The decision came in the wake of a deepening crisis within the ruling Nepal Communist Party.</p>



<p>Oli was elected prime minister in February 2018 after the alliance of his CPN-UML and Dahal’s CPN (Maoist Centre) was handed a majority in the 2017 elections. The two parties had merged in May 2018 to form the Nepal Communist Party.</p>



<p>There are two factions clearly observed within the ruling Nepal Communist party- Puspakamal Dahal- Madhav Nepal are leading one team while Prime Minister KP Oli is leading another.</p>



<p><strong>Seven cabinet ministers of the Cabinet have resigned</strong></p>



<p>Following the dissolution of the House of Representatives of the Federal Parliament, seven cabinet ministers submit resignations over PM Oli’s decision to dissolve parliament. All the seven ministers, who belong to the Pushpa Kamal Dahal-Madhav Nepal faction in the ruling Nepal Communist Party.</p>

<p>Nepalis and Indians flying to each other&#8217;s countries are not required to undergo quarantine if they have a negative virus test report completed less than 72 hours before departure, Nepal Airlines said on Thursday, as it resumed services to New Delhi after a nine-month break.</p>



<p>“People are confused about the quarantine requirement. Travellers from both countries will not have to quarantine themselves if they have a valid negative RT-PCR (reverse transcription-polymerase chain reaction) test report,” said Anil Ghimire, deputy director of the national flag carrier&#8217;s customer service department at Tribhuvan International Airport.</p>



<p>“As cases of fake RT-PCR reports have been rising, we have made it mandatory for travelers to bring the original report that is stamped or certified by the lab,” he said, adding that several passengers holding scanned copies were found to have falsified reports. <a href="https://www.civilaviation.gov.in/sites/default/files/05112020Guidelinesforinternationalarrivals.pdf">According to the guidelines</a> for international arrivals issued by the Indian Ministry of Health and Family Welfare, all travelers should submit a self-declaration form on the online portal (www.newdelhiairport.in) at least 72 hours before the scheduled travel or physically after arrival at the respective health counters.</p>
