A special court is hearing the bail application of Bollywood actor Shah Rukh Khan’s son, Aryan Khan, and four others Wednesday.
Earlier on Friday, the bail plea application of Aryan Khan, Arbaz Merchant, and Munmun Dhamecha was rejected by the Killa Court in Mumbai in connection with a cruise drugs bust case.
According to the Indian Express, the NCB on Wednesday opposed the bail plea filed by Aryan Khan, son of Bollywood superstar Shah Rukh Khan, saying that the probe so far has revealed his role in the conspiracy and illicit procurement and consumption of drugs. Lawyers representing the five accused had filed a bail plea special court designated under the Narcotic Drugs and Pyschotropic Substances (NDPS) Act.
The NCB submitted that there is a close nexus among all accused. The agency added that there have been several seizures of intermediary quantities of drugs from Aryan Khan’s co-accused and there has also been seizure of commercial quantities of Mephedrone from one accused, the outlet reported.
Earlier, Special Judge V V Patil, hearing matters related to the Narcotics Drugs and Psychotropic Substances (NDPS) Act, said the court would hear the bail plea on Wednesday after the NCB said there was “no extreme urgency” to hear the application and sought a week to file an affidavit.
The defense said Aryan Khan was “falsely implicated” and releasing him on bail would not stop the probe.
According to screenshots of the NCB documents posted by Livelaw, here’s what the NCB told the court on Wednesday to argue against bail for Aryan Khan:
- Aryan Khan would procure contraband from his friend Arbaz Merchant, who was also arrested along with him. Six grams of charas was recovered from him during the raid.
- Aryan Khan is in touch with persons who are a part of the ‘international drug network’ for illegal procurement of drugs.
- He may tamper with evidence, may influence witnesses, considering accused holds an influential position in the society.
- On CCTV footage of cruise raid, NCB said ‘such a demand would cause great prejudice to the ongoing investigation’. The relevance of CCTV footage will be decided at the time of trial.
- Allegation of false implication untrue and misleading, says NCB
- Aryan and Arbaaz have been closely associated with each other which is sufficient to attract offences more particularly Section 29 of the NDPS Act.
- Accused Aachit and Harijan supplied charas to Aryan and Arbaaz. They form a part of a larger chain, nexus and their involvement in the conspiracy to commit illegal acts and violations cannot be ruled out.
- In such a situation, the quantum of recovery from an individual becomes inconsequential. This is especially important because Aryan’s biggest defence ha sbeen that no drugs were recovered from his person during the raid.
Shah Rukh Khan’s son Aryan Khan will spend another night in jail as the hearing on his bail plea was adjourned and arguments will continue Thursday noon.
Aryan Khan, 23-Year-Old, was arrested along with Merchant, Dhamecha, and others after the Narcotics Control Bureau (NCB) raid on a cruise ship on October 2 from where the agency recovered drugs. They were detained after the raid last Saturday and then arrested the next day.
