    India: Court Dismisses Rahul Gandhi’s Appeal

    India’s Congress leader Rahul Gandhi’s application filed against the stay on conviction has been rejected by the Surat Sessions Court. Actually, the lower court had sentenced him to two years in the ‘Modi surname’ case.

    With this court rolling, Rahul Gandhi’s Parliament membership will not be restored for the time being. After the decision of the Surat Sessions Court, it has been told from the Congress side that the court refused to give a stay order on the conviction. Rahul Gandhi will go to the High Court tomorrow after taking a copy of the order, reported Indian media outlets.

    In the sessions court, Rahul’s lawyers had argued that the Congress leader had given a statement on the issue of corruption and his intention was not to insult the Modi community. It was also said that it is not appropriate to give maximum punishment to Rahul in this case.

    Rahul’s team is left with the option of going to the High Court and the Supreme Court. Meanwhile, the tension for the Congress will also be that the Election Commission may not announce elections in Wayanad. If this happens then the difficulties of the former Congress President may increase further. Since morning, the eyes of the whole country were on the Surat court. Congress party leaders and workers engaged in Karnataka election campaign were expecting good news but it did not happen. Had the judgment of conviction and sentencing been stayed, Rahul’s Lok Sabha membership would have been restored. In such a situation, he could appear in the Parliament again.

    Last Thursday, the court of Additional Sessions Judge RP Mogera had reserved the decision on Rahul Gandhi’s application till April 20. Rahul has been sentenced to 2 years in the ‘Modi surname’ defamation case and later lost his MP. Rahul Gandhi was an MP from Wayanad in Kerala since 2019. Rahul had reached the sessions court on April 3 against the order of the lower court. The lawyers gave two applications. Out of this, one was for stay of sentence and the other was for suspension of conviction. While granting bail to Rahul, the court had given notice to complainant Purnesh Modi and the state government. After this the court heard all the parties.
