In a shocking move, Britney Spears’ father James Spears has asked a judge to end the court conservatorship that has controlled both the person and estate for 13 years.
On Tuesday, James Spears officially filed his petition to terminate the conservatorship in Los Angeles Superior Court.
Judge Brenda Penny who oversees the case, will need to approve the filing to free Britney from the court Conservatorship.
According to court documents posted on Twitter, Jamie stated in his filing on Tuesday that Britney may no longer need a conservatorship.
According to Jamie Spears’ filling, seen by GNB, says his daughter “is entitled to have this Court now seriously consider whether this conservatorship is no longer required.” The filing went on to say Britney Spears’ circumstances have changed “to such an extent that grounds for the establishment of a conservatorship may no longer exist.”
“Ms. Spears has told this Court that she wants control of her life back without the safety rails of a conservatorship,” the filing continues. “She wants to be able to make decisions regarding her own medical care, deciding when, where, and how often to get therapy. She wants to control the money she has made from her career and spend it without supervision or oversight. She wants to be able to get married and have a baby if she so chooses. In short, she wants to live her life as she chooses without the constraints of a conservator or court proceeding.”
Spears’ lawyer Matthew Rosengart called it ” a massive legal victory for Britney Spears, as well as vindication.”
NBC News was first to report the news of Jamie’s petition.
Britney Spears, 39, has tried to remove her father from her case twice in the last two years, saying last year that she refuses to perform while he retains control over her in any capacity. She told Superior Court Judge Brenda Penny during her testimony on June 23 that her father had ruined her life and “loved” to hear her in pain while he exerted his power over her.
