A federal judge has modified restrictions on Elon Musk’s Department of Government Efficiency (DOGE), granting limited access to certain U.S. Treasury Department data. The decision has sparked debate over balancing government modernization efforts with data privacy protections.

Limited Access Approved with Conditions

On April 11, 2025, U.S. District Judge Jeannette A. Vargas partially lifted a prior ban, allowing Ryan Wunderly, a DOGE staffer, to access Treasury payment systems and sensitive financial data under strict conditions. Wunderly must complete the Treasury Department’s standard data-handling training and submit a financial disclosure report, requirements typically applied to civil servants handling such information. This ruling stems from a lawsuit filed by 19 Democratic state attorneys general, who argued that DOGE’s political appointees lack the training and oversight of career officials, potentially risking the security of sensitive data like Social Security numbers and bank account details, according to ABC News.

Court of Appeals Adjusts Data Access Restrictions

Separately, on April 7, 2025, the 4th U.S. Circuit Court of Appeals issued a 2-1 ruling that paused an injunction, restoring DOGE’s access to sensitive data at the Treasury Department, Education Department, and Office of Personnel Management. However, access to Social Security Administration (SSA) databases remains restricted pending further legal review, reflecting heightened concerns about the volume and sensitivity of SSA data, as reported by Bloomberg Law.

Concerns Over IRS “Mega API” Development

DOGE’s reported collaboration with Palantir Technologies to develop a centralized data interface, referred to as a “mega API,” has drawn attention. The system aims to modernize access to Internal Revenue Service (IRS) records, potentially enabling real-time data retrieval. While proponents argue it could enhance efficiency, critics warn that consolidating access to taxpayer information could increase risks of misuse or breaches, particularly given DOGE’s temporary and politically appointed structure. No primary source confirms the “mega API” label or its full scope, so details remain speculative based on available reporting from Financial Express.

Government Watchdog Probes DOGE Operations

The Government Accountability Office (GAO) is auditing DOGE’s data-handling practices across multiple agencies, including the Departments of Labor, Education, Treasury, Health and Human Services, Homeland Security, and the SSA. Initiated in March 2025, the probe examines compliance with federal privacy laws and security protocols, prompted by concerns over DOGE staff accessing sensitive systems without adequate training or authorization. The audit’s findings could influence future oversight of DOGE’s activities, according to Inc.

Implications for Privacy and Governance

Judge Vargas’ ruling seeks to balance DOGE’s mission to streamline government operations with safeguards to protect sensitive data. However, privacy advocates and some lawmakers remain wary, citing the potential for political appointees to access personal information without sufficient checks. The ongoing legal battles and GAO audit underscore broader tensions between executive-led efficiency drives and established data protection frameworks.
