The Supreme Court on Friday ruled that the Texas abortion providers can sue over Texas’ near-total ban on abortions. But the Supreme Court refused to block the law in the meantime, ruled that lower courts should consider the matter.

With this ruling, the Texas abortion law that bars the procedure after around six weeks of pregnancy remains in place for now.

The decision is a victory for opponents of the law, which prohibits abortions in the state after about the sixth week of pregnancy before many women know they are pregnant.

Justice Gorsuch stresses “the ultimate merits question” of whether the Texas law is constitutional “is not before the Court.” The ruling simply allows the clinics’ lawsuit to go forward in the lower courts.
